Terms of Service

1. Introductory provisions

Welcome to the Portiny app. These terms and conditions (the "Terms") govern the use of our web service and application available at portiny.com and its subdomains (the "Service").

By registering for or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Service description and Trial

Portiny is a headless low-code/no-code platform that allows companies to digitize processes and build custom apps without writing code. The Service operates on a recurring monthly subscription basis (SaaS).

  • Free Trial: Each new user is entitled to a 14-day free trial after registration. During this period you can test the Service features at no charge.
  • After the trial period ends, a paid subscription is required to continue using the Service.

3. Payments and Subscription

Payments for the Service are processed through the secure payment gateway Stripe.

  • Subscription: The Service is billed monthly or yearly in advance.
  • Subscription cancellation: You can cancel your subscription at any time in your user account. Cancellation takes effect at the end of the current billing period. Until then, you can continue to use the Service in full.
  • Refunds: Subscription fees already paid are non-refundable. We do not provide prorated refunds for unused time if you cancel during a billing cycle.

4. Data and Rights

Portiny serves as a tool for managing your data.

  • Data ownership: All data you enter into the system and the apps you create are your property.
  • Availability: We guarantee high availability of the Service; however, we recommend regular backups of key data using the export tools provided by Portiny.
  • Responsibility: The user bears full responsibility for the data entered into the system and for the way the created apps are used.

5. Fair Use Policy

To ensure high-quality service for all users, we apply a Fair Use Policy.

  • Within your subscription, you may use the system within the limits defined by your plan (storage).
  • It is strictly prohibited to use the Service to store illegal content or for activities that violate the laws of the Czech Republic.
  • If excessive load is detected, we reserve the right to limit or suspend access to the account.

6. Limitation of liability

The Service is provided "as is". The Provider does not guarantee uninterrupted availability of the Service or that it will be error-free.

The Provider is not liable for any direct or indirect damages, lost profits, or loss of data arising in connection with the use of or inability to use the Service.

7. Final provisions

These Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts in the Czech Republic.

We reserve the right to change these Terms at any time. We will inform you of changes by email or through the application.
